Terms and conditions of trade and website use
Terms and conditions apply to all transactions on this site. They do not affect your statutory rights
If there are any Changes in terms and conditions, these changes will apply from the date they are posted on the site (see above date)
We Accept Payments by credit or debit card. Payments are handled by the worldpay payment gateway. We don't store your sensitive information and never pass anything on to 3rd parties. Upon payment for your goods you will be redirected to worldpays' secured payment pages. To protect against fraud we use 3d secure technology to verify you are the cardholder.
Unfortunately at present goods can only be delivered to the cardholders registered address. This is to protect from fraudulent activities.
Delivery of Goods
Animal & Garden shall ship the goods to the delivery to the billing address which is submitted at the checkout. All delivery times quoted are estimates only. Title to goods will be passed on to you on payment in full. Risk will be passed to you on delivery.
You will have the opportunity to check and correct any input errors in your order at any point until you click reicieve an "order completed email"
After your order has been submitted you will be emailed an order reference number and an invoice
of the products you have ordered. Acceptance of your order and creation of a legally binding
contract between us will only occur when we send you an "order complete email" which will confirm your order and contain details of how we will deliver your products to you. (we may decline all or part of you order for any reason, if this is the case you will be notified by email).
In certain circumstances where the value of the order is over a certain amount we may decide to deliver the items ourselves and only when we have cleared funds in our bank account. If this is not possible or acceptable to the customer we will issue a refund and cancel the order
The prices and charges on our site are values in British sterling and are VAT inclusive
Prices, offers and products are subject to availability and may change before we accept your order, if a product becomes unavailable we may offer an alternative or that product can be withdrawn from the order and refunded to you in full.
We try to ensure that the contents of this website and the information displayed is accurate, however errors can occur. If an error is discovered in the price of a product you have ordered , we will contact you via email and ask if you would wish to continue with the ordering of this item or cancel it.
We only currently deliver to the UK. All deliveries must be signed for. When your order is placed you will be notified which day the order will be delivered.
Currently we only offer a 1-3 day delivery service, although if your order is completed before 1pm then there is a strong possibility you shall receive your good the next day between the times of 9 am to 5 pm. If you need your goods delivered the next working day, please give us a call after you've placed your order and we shall do our best to fulfil your request.
If you order after 1pm then your goods will be dispatched the following day and delivery 1-3 days after. delivery excludes Saturday’s, Sunday’s and bank holidays. For all other queries please refure to the delivery of goods section
Missing, Damaged or Incorrect orders
Any claim that any goods or services have been delivered damaged, are not of the correct quantity or does not comply with their description, shall be notified by the customer to Animal and Garden Supplies within 48 hours of the delivery time. We cannot accept responsibility for any errors/damages notified after that time. You may be asked to provide photos of damaged good to make a claim.
Any claim must contain full details of the claim including any reference numbers of any defected goods or services. Where possible, please provide photographic evidence of damaged goods. Email all photographs to firstname.lastname@example.org
Animal & Garden shall be afforded reasonable opportunity and facilities to investigate any claims made under this condition and the customer shall if so requested in writing by the company promptly return any goods or services the subject of any claim and any packing materials securely packed and paid to the company for examination
The company shall have no liability with regard to any claim in respect of which the customer has not complied with the claims procedures in these conditions.
Guarantee and Returns policy
If you are not completely satisfied with any item that you have purchased from us, you may return the item within 7 days of receipt for a full refund of the purchase price, minus the shipping & handling fees. In this case the customer will be responsible for all shipping cost incurred when returning the item.
You shall be responsible for the cost of returning for refunds or exchange, except in cases of faulty or damaged items. It is recommended that you use registered post or recorded delivery when returning goods and that you package your items appropriately to avoid damage in transit.
If goods are damaged or faulty, we shall try to replace the item, although if this isn’t possible our only obligation is to refund the full amount paid by you.
All items must be returned unused and in a re-sellable condition, including packaging. If items are returned in breach of these conditions then they will be subject to a 30% handling charge together with collection charges where applicable.

If an order is completed via the telephone, the customer is responsible that the sizes, models & choice of product are correct. Any costs associated by us in changing these products will be charged to the customer
Animal & Garden own the copyright, trademarks and all other intellectual property rights in all material and content on this website. Commercial use of this material or content is strictly forbidden.
You may not create any link to this website.
Any claim under this condition must be in writing and must contain full details of the claim including the reference numbers of any allegedly defective goods or services.

Governing Law and Jurisdiction
These terms and conditions shall in all respect be construed and interpreted in accordance with the law of contract in England and Wales notwithstanding the effect of the law of the European union. Where the company and the customer have contracted to perform in England or Wales or Scotland and the competent court of jurisdiction shall be the high court of England and Wales.
Invalidity of Terms and Conditions
Under no circumstances shall the company have any liability of whatever kind for:
Any defects resulting from wear and tear, accident, improper use by the customer or use by the customer except in accordance with the instructions or advice of the company or the manufacturer of any goods or services or neglect or from any instructions or materials provided by the customer.
Any goods and services which have been adjusted, modified or repaired except by the company
The suitability of any goods or services for any particular purpose or use under specific conditions whether or not the purpose or conditions were know or communicated to the company
Any substitutions by the company of any materials or components not forming part of any specification of the goods or services agreed in writing by the company.
Any specifications, descriptions, illustrations, figures as to performance, drawings and particulars of dimensions and weights submitted by the company contained in the company’s catalogues, price lists or else ware since they are merely intended to represent a general idea of the goods or services and not to form part of the contract or to be treated as representations
Any technical information, statements, recommendations, or advice furnished by the company it’s servants or agents not given in writing in response to a specific written request from the customer before the contract is made, or
Any variations in the quantities or dimensions of any goods and services or changed of their specifications or substitutions of any materials or components; if the variation or substitution does not materially affect the characteristic of the goods or services, and the substituted material or components are of a quality equal or superior to those originally specified.
If for any reason part of these terms and conditions are unenforceable, the validity of the remaining terms and conditions shall not be affected.
